Corporal punishment is a method of physical discipline intended to cause pain to a person. When it’s inflicted on minors, especially in home and school settings, its methods may include spanking or caning.

Corporal punishment or violent discipline by caregivers is the most common form of violence against children. Worldwide, 4 out of 5 children aged 2 to 14 are affected by corporal punishment. This happens in many basic settings – at home, in the classroom, in childcare, and in juvenile detention centres. And today, 86% of children in the world are not legally protected from this practice.

While corporal punishment can lead to immediate obedience, researchers have found that the behavioural changes may only be short-term. Studies consistently show that corporal punishment is ineffective in the long run and may even cause behaviour problems to worsen over time.

For example, hitting children reinforces aggressive behaviour. A variety of research studies have found that children who are hit are more likely to hit other people. The reason is simple. Physical punishment models aggressive behaviour, which teaches children to use violence to solve problems. It can also lead to bullying, dating violence, and other problem behaviours that involve having power over others.

Spanking and other physical punishment damage the relationship between children and their parents or caregivers. Here are some reasons why corporal punishment shouldn’t be tolerated by any society: 

• It is a form of child abuse
• It can increase aggression
• Antisocial behaviour
• Physical injury
• Mental health issues
• Poor educational outcomes
• Perpetration of violence 
• Lack of acceptance by peers 
• Depression Disorder 
• Psychological Damage

The End Corporal Punishment profile for Thailand states that “The Global Initiative no longer considers Thailand committed to prohibiting all corporal punishment of children without delay, as corporal punishment continues to remain lawful…” A further study conducted by YouGov determined that “80% of Thai parents suffered at least one form of corporal punishment growing up” and “parents that have experienced physical discipline growing are more likely to inflict it.”

This year Childline Thailand are joining the global event by launching a facebook group aimed at educating parents about breaking the cycle of violence and raising awareness about the negative health, developmental and behavioural outcomes for children who are punished with anger or assault. “Aside from the pain and humiliation corporal punishment can cause, it also impacts children’s long-term health and well-being, causing a ripple effect for decades to come.” (end-violence.org)

April 30th is the International Day to End Corporal Punishment of Children,  50% of all school-age children in the live in countries where corporal punishment at school is not fully prohibited leaving 720 million children without legal protection.

But this month, the world is coming together to push for something better.

End Violence has issued a statement that calls on all governments to prohibit corporal punishment and begin the legislative process to do so. We are asking everyone – from governments to organisations to individuals – to endorse this statement and showcase the widespread support for universal prohibition.

30 เมษายน วันยุติการลงโทษทางร่างกายต่อเด็กสากล!

มูลนิธิสายเด็ก ขับเคลื่อนประเด็น “ยุติการลงโทษทางร่างกายต่อเด็ก” มาโดยตลอด เพราะ เด็กไม่สมควรได้รับความรุนแรงใด ๆ ทั้งสิ้น แต่ว่าความรุนแรงต่อเด็ก ไม่ว่าจะในบ้าน สถานดูแลเด็กหรือโรงเรียน ยังคงมีอยู่ เพราะกฎหมายไม่ได้กำหนดโทษไว้อย่างชัดเจน อีกทั้งผู้ใหญ่หลายคนเชื่อว่า “ความรุนแรงแก้ไขปัญหาได้”

ในปี 2543 กระทรวงศึกษาธิการได้ออกระเบียบ ยกเลิกการลงโทษเด็กและนักศึกษาด้วยความรุนแรง แต่ผลสำรวจจากสถาบันวิจัยเพื่อการพัฒนาประเทศไทย เผยว่ามีนักเรียนในกรุงเทพฯ จำนวน 61.4% โดนกระทำความรุนแรงจากคุณครู ส่วนนักเรียนทางต่างจังหวัด ถูกทำความรุนแรงสูงถึง 70%

แถลงการณ์นโยบายยุติการลงโทษทางร่างกายต่อเด็กระดับสากลระบุว่า ประเทศไทยไม่ได้ให้ความสำคัญกับ “นโยบายยุติความรุนแรงต่อเด็ก” แม้แต่น้อย ปล่อยให้ความรุนแรงเกิดขึ้นอย่างต่อเนื่อง ไม่ปรับกฏหมายการอบรมเลี้ยงดูบุตรให้ไร้ซึ่งความรุนแรง ทางด้านผลการศึกษาของ YouGov ระบุว่า “ผู้ปกครองไทย มากกว่า 80% เคยโดนกระทำความรุนแรง และอาจจะส่งต่อความรุนแรงต่อลูกหลานเช่นกัน”

ปี 2564 นี้ มูลนิธิสายเด็กได้เข้าร่วมนโยบายระดับสากล ด้วยการเปิดตัวกลุ่มเฟซบุ๊ก “ประเทศนี้ไม่ตีเด็ก” เพื่อรวบรวมเสียงของทุกคนที่เห็นด้วยกับการอบรมเลี้ยงดูเด็กโดยไม่ใช้ความรุนแรงและต้องการปรับปรุงประมวลกฎหมายแพ่งและพาณิชย์ มาตรา 1567 อนุ 2 และให้ความรู้ ความเข้าใจถึงผลกระทบของการตีเด็ก ไม่ใช่แค่ร่างกายจะเจ็บเท่านั้น เพราะสภาพจิตใจอาจบอบช้ำและเด็กอาจซึมซับพฤติกรรมรุนแรง ใช้อารมณ์ตัดสินปัญหามากกว่าเหตุผล สุดท้ายความรุนแรงนี้จะส่งผลกระทบด้านลบต่อสังคมในวงกว้าง

ในหลายประเทศที่ไม่ได้ออกกฎหมายห้ามการใช้ความรุนแรงต่อเด็ก มีจำนวนเด็กมากกว่า 50% หรือ 720 ล้านคน กำลังเสี่ยงกับความรุนแรงโดยไม่ได้รับการปกป้องจากกฎหมายฉบับใด ๆ 

ทว่าในเดือนนี้ โลกกำลังร่วมมือป้องกันเด็กจากความรุนแรง

ผู้ที่เกี่ยวข้องกับนโยบายนี้ ได้แถลงการณ์เรียกร้องให้รัฐบาลทุกประเทศสั่งห้ามทุกฝ่าย เลิกใช้ความรุนแรงต่อเด็ก ปรับปรุงกฎหมายให้ปกป้องเด็กจากการอบรมเลี้ยงดูอย่างไม่เหมาะสม และขอการสนับสนุนไม่ว่าจะเป็นรัฐบาล องค์กรเอกชนหรือบุคคลทั่วไปร่วมกันรองรับนโยบายนี้และร่วมส่งต่อแถลงการณ์ด้วยกันเพื่อผลักดันเป็น นโยบายระดับสากล
